This policy in the field of processing and protection of personal data (hereinafter - the “Policy”) Joint Stock Company “Innovation Center ‘Bourevestnik’ (short name: the Bourevestnik, JSC), registered at the address: 197350, St. Petersburg, 3rd Letchika Parshina St., bld.1, (hereinafter - the ‘Company’, ‘Site Administration’, ‘we’), is developed in order to ensure the implementation of the requirements of the legislation of the Russian Federation in the field of processing personal data of personal data subjects on the resource located at: www.bourevestnik.ru (hereinafter - “Site”).

The Company's Policy is developed in accordance with the following regulatory legal acts of the Russian Federation:

  • Constitution of the Russian Federation;

  • Labor Code of the Russian Federation;

  • Civil Code of the Russian Federation;

  • Federal Law No. 160-FZ dated 19.12.2005 “On Ratification of the Council of Europe Convention for the Protection of Individuals with regard to Automatic Processing of Personal Data”;

  • Federal Law of 27.07.2006 No. 152-FZ “On Personal Data”;

  • Federal Law of 27.07.2006 No. 149-FZ “On Information, Information Technologies and Information Protection”;

  • Decree of the President of the Russian Federation No. 188 dated 06.03.1997 “On Approval of the List of Confidential Information” and other regulatory legal acts of the Russian Federation in the field of information and personal data protection;

  • General Data Protection Regulation (Regulation (EU) 2016/679 of the European Parliament and of the Council of April 27, 2016 - The General Data Protection Regulation, “GDPR”).

This Privacy Policy contains information about what information the Company receives, the reasons why the Company needs this information, and how the Company may use and share this information. The Site and the services provided by www.bourevestnik.ru are intended only for persons 18 years of age or older. 1. DEFINITION OF TERMS:

The following terms are used in this Privacy Policy:

1.1. “Site Administration” - authorized employees to manage the site, acting on its behalf, which organizes and (or) carries out the processing of personal data, as well as determines the purposes of personal data processing, the composition of personal data subject to processing, actions (operations) performed with personal data.

1.2 “Personal Data” means any information relating directly or indirectly to a certain or definable natural person (subject of personal data).

1.2.1 “Operator” - a legal or natural person organizing and carrying out the processing of personal data, as well as determining the purposes and content of personal data processing. the Bourevestnik,JSC - Operator, independently or jointly with other persons organizing and (or) carrying out processing of personal data, as well as determining the purposes of personal data processing, composition of personal data subject to processing, actions (operations) performed with personal data.

1.2.2 “Automated processing of personal data” means processing of personal data by means of computer equipment.

1.2.3 “Personal Data Subject” - a natural person to whom the relevant personal data relate.

1.2.4 “Website User (hereinafter - ‘User’, ‘you’)” - a person who has access to the site, via the Internet and uses the site for his/her own purposes.

1.2.5. “Cookies” - a small piece of data sent by the web server and stored on the user's computer, which the web client or web browser sends to the web server in an HTTP request each time it tries to open a page of the respective website.

1.2.6. “IP address” - a unique network address of a node in a computer network based on the IP protocol.

2. GENERAL PROVISIONS

2.1 The use of the Site by the User means consent to this Privacy Policy and the terms of processing the User's personal data.

2.2 In case of disagreement with the terms of the Privacy Policy the User should stop using the Site.

2.3 This Privacy Policy applies only to this site. The Administration of the site does not control and is not responsible for the sites of third parties, to which the User can go through the links available on this Site.

2.4 Administration of the site does not check the accuracy of personal data provided by the User of the Site.

2.5 The information databases containing personal data shall be placed on the territory of the Russian Federation.

3. SUBJECT OF PRIVACY POLICY

3.1 This Privacy Policy establishes the obligations of the Site Administration on willful non-disclosure of personal data that the User provides at various requests of the Site Administration (for example, when registering on the site, placing an order, subscribing to notifications, etc.).

3.2 Personal data allowed for processing under this Privacy Policy is provided by the User by filling out special forms on the Site and usually includes the following information:

We add this information to the information we already have on an existing user account information to better understand customer preferences, provide relevant product recommendations and engaging advertising, enhance the safe use of our Site for our customers, and to comply with our legal obligations, including sanctions law. 4. USE OF PERSONAL DATA

4.3 The User agrees that the Administration of the site has the right to transfer personal data to third parties: courier services, postal organizations, telecommunication operators, solely for the purpose of fulfillment of the User's requests made on the site, within the framework of the Public Offer Agreement.

4.4 The User's personal data may be transferred to authorized government authorities only on the grounds and in accordance with the procedure established by applicable law.

4.5 The Company has the right to supplement, correlate and combine the received personal information with information about the User received from other sources.

4.6 The Company has the right to aggregate the User's personal information with information about other buyers, creating a database on the use of the Site, the ordering of goods and other generalized information about buyers, based on legitimate interests, in order to better understand the demand for certain goods and services in general.

4.7 The Site contains links to other web resources, where useful and interesting for the Site users information may be located, including links to such resources as: https://www.vkontakte.ru; https://rurube.ru; http://www.yandex.dzen.ru;. In this case, the effect of this Policy does not apply to such other sites. Users who follow links to other sites are advised to familiarize themselves with the Data Processing Policies posted on such sites.

5. ACCESS TO PERSONAL DATA

5.1 To ensure operation of the Website and provision of services in accordance with the above purposes, the Company may store and transfer personal data received from Users outside the USA, PRC and European Economic Area.

5.1.1 The Bourevestnik, JSC has the right to provide your personal data for the purposes of conducting business, ensuring the use of the Site and providing our services to you. These companies use your personal information in accordance with this Privacy Policy;

5.1.2 To third parties who provide services to the Company in order to supplement information already held and to further provide services and products:

5.1.2.1 Courier companies that we partner with to provide delivery, of the goods you have ordered. For this purpose, they need access to your order details, including your name and address. These service providers operate worldwide, working with many local companies that may be included in the delivery process to your address.

5.1.2.2 Credit Check and Fraud Detection Service Provider companies ensure your and our security. We give them access to personal data and orders placed in order to detect fraudulent activity.

5.1.2.3. analytics companies and search engine developers who help us improve and optimize the Site.

5.1.2.4 Providers of marketing tools that facilitate commercial promotion.

5.1.2.6. Providers of plugins or similar technologies that help us track traffic, affiliate boutiques and other providers.

5.1.2.7. Research companies we partner with to conduct surveys regarding the usability of our Site and services.

5.1.2.8. IT providers who provide us with IT support services for our Site and the storage of your data.

5.2 Many of the above recipients of Personal Data are located in the Russian Federation, the European Union/European Economic Area and other countries. However, in some cases, Personal Data may be transferred outside the European Economic Area, including to countries that do not provide the same high level of protection for Personal Data as the European Economic Area and are not subject to European Commission decisions. If Personal Data must be transferred to one of these countries, the Company will, where necessary under applicable data protection laws, ensure an adequate level of data protection through some recognized legal mechanism, such as Privacy Shield certification between the EU and the U.S., so-called Standard Contractual Clauses published by the European Commission, or Binding Corporate Rules. Please note that such a recognized legal mechanism is not required when the transfer is necessary for the performance of a contract concluded for the benefit of the User between the Company and another person or entity (as well as for the conclusion of such a contract), such as the third-party service providers referred to in clause 5.1.2. In cases where the Company makes cross-border transfers of Personal Data to the Company's subsidiary legal entities, the Company undertakes to comply with the so-called Standard Contractual Clauses in order to ensure that the transfer of Personal Data is adequate to ensure adequate protection of the User's interests.

7. SECURITY

7.1 The Company takes a number of actions to protect the personal information that Users provide:

8. STORAGE PERIOD OF YOUR PERSONAL DATA

8.1 The processing of the User's Personal Data shall be carried out solely until the aforementioned processing purposes for which we collected or received your Personal Data have been achieved and until the retention period set forth by applicable law has been reached.

8.2 The User agrees that the Website Administration has the right to transfer Personal Data to third parties, in particular, courier services, postal organizations, telecommunication operators, solely for the purpose of fulfilling the User's order placed on the Website, including the delivery of Goods.

8.3 The User's personal data may be transferred to the authorized state authorities of the Russian Federation only on the grounds and in accordance with the procedure established by the legislation of the Russian Federation.

8.4 The Administration of the site takes the necessary organizational and technical measures to protect the User's personal information from unlawful or accidental access, destruction, modification, blocking, copying, distribution, as well as from other unlawful actions of third parties.

8.5 The site Administration together with the User takes all necessary measures to prevent losses or other negative consequences caused by the loss or disclosure of the User's personal data.

9. RIGHTS AND DISPUTE RESOLUTION

9.1 The User has the right to demand:

9.1.1 Confirmation of the fact of processing of Personal Data, and in case of confirmation of the fact of processing, - access to the Personal Data;

9.1.2. Elimination of inaccuracies in the Personal Data;

9.1.3. Destruction of Personal Data;

9.1.4. Termination of processing of Personal Data;

9.1.5. Receipt of Personal Data and unhindered transfer of such Personal Data to another personal data controller.

9.2 The website administration has the right:

9.2.1. Use the received information exclusively for the purposes specified in clause 4 of this Privacy Policy.

9.2.2 Not to disclose the User's personal data, except for clauses. 8.2. and 8.3. of this Privacy Policy.

9.2.3. Block personal data related to the respective User from the moment of application or request of the User, or his legal representative or the authorized body for the protection of the rights of personal data subjects for the period of verification, in case of identification of unreliable personal data or unlawful actions.

9.3 Administration of the site is responsible for willful disclosure of the User's Personal Data in accordance with applicable law, except as provided for in paragraphs. 8.2., 8.3. and 9.4. of this Privacy Policy. Persons guilty of violating the rules governing the receipt, processing and protection of personal data shall bear disciplinary, material, administrative, civil, criminal and other liability provided for by the legislation of the Russian Federation.

9.4 In case of loss or disclosure of Personal Data, the Website Administration shall not be liable if this confidential information:

9.7 The recipient of the claim within 30 calendar days from the date of receipt of the claim, shall notify the claimant in writing of the results of consideration of the claim.

9.8 In case of failure to reach an agreement, the dispute will be referred to a judicial body for consideration in accordance with the current legislation.

9.9 The current legislation applies to this Privacy Policy and the relationship between the User and the Administration of the site.

10. QUESTIONS AND COMMENTS

10.1 The Website Administration has the right to make changes to this Privacy Policy without the User's consent.

10.2. The new Privacy Policy comes into force from the moment of its placement on the Site, unless otherwise provided by the new version of the Privacy Policy.

The Bourevestnik, JSC (hereinafter - “Company”, “we”, “us”, “our”, etc.) operates the website located at www.bourevestnik.ru (hereinafter - “Site”).
